1. Introduction

These Terms of Service ("Terms") govern your use of the Planet MTB website and participation in any tours, trips, events, coaching sessions or services operated by Planet MTB ("Planet MTB", "we", "our", "us").

By making a booking, using our website, or participating in any Planet MTB service, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not use our services.


2. Eligibility

Participants must:

  • Be physically capable of participating in mountain biking activities.
  • Accurately disclose any relevant medical conditions.
  • Follow all instructions provided by Planet MTB staff and guides.
  • Meet any minimum age requirements specified for a particular tour.

Participants under 18 years of age must have a parent or legal guardian complete all booking documentation and accept these Terms on their behalf.


3. Bookings and Deposits

A booking is confirmed once:

  • A completed booking has been received; and
  • The required deposit payment has been paid.

Planet MTB reserves the right to decline any booking at its sole discretion.


4. Payment Terms

Deposit

A non-refundable deposit equal to 20% of the total tour price is required to secure your booking.

Final Payment

The remaining balance must be paid no later than 30 days prior to the tour commencement date.

Failure to pay the remaining balance by the due date may result in cancellation of your booking without refund of any amounts already paid.


5. Cancellations and Refunds

Participant Cancellation

If you cancel your booking:

  • Deposits are non-refundable.
  • Cancellations made more than 60 days before departure may receive a refund of payments made excluding the deposit.
  • Cancellations within 60 days of departure are non-refundable unless otherwise agreed by Planet MTB.

Transfers

At Planet MTB's discretion, bookings may be transferred to another rider or future trip where practical.

Any transfer fees or supplier charges may be passed on to the participant.

No Shows

Failure to attend a tour without prior notice will result in forfeiture of all payments made.


6. Tour Changes

Planet MTB reserves the right to modify:

  • Itineraries
  • Accommodation
  • Guides
  • Transport arrangements
  • Ride locations
  • Activities

Changes may occur due to weather, trail closures, safety concerns, supplier availability, force majeure events or circumstances beyond our control.

We will always endeavour to provide a comparable alternative where possible.


7. Travel Requirements

Participants are responsible for:

  • Obtaining valid passports and visas where required.
  • Meeting airline requirements.
  • Ensuring bikes and equipment comply with airline and destination requirements.
  • Obtaining appropriate travel insurance.

Planet MTB strongly recommends comprehensive travel insurance that covers:

  • Trip cancellation
  • Medical expenses
  • Mountain biking activities
  • Bike damage and theft
  • Emergency evacuation

8. Rider Responsibility

Participants are responsible for:

  • Maintaining their own bike and equipment.
  • Ensuring their bike is safe and mechanically sound.
  • Wearing an approved helmet while riding.
  • Following local laws and trail regulations.
  • Riding within their own skill level.

Planet MTB reserves the right to remove any participant whose behaviour is unsafe, reckless, abusive or disruptive.

No refunds will be provided in these circumstances.


9. Assumption of Risk

Mountain biking is an inherently dangerous activity.

Participation involves risks including but not limited to:

  • Falls
  • Collisions
  • Equipment failure
  • Serious injury
  • Permanent disability
  • Death

By participating, you acknowledge these risks and voluntarily assume responsibility for your participation.


10. Limitation of Liability

To the maximum extent permitted by law:

Planet MTB, its directors, employees, contractors, guides and representatives shall not be liable for:

  • Personal injury
  • Illness
  • Property damage
  • Loss of equipment
  • Delays
  • Travel disruptions
  • Indirect or consequential losses

arising from participation in Planet MTB services.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.


11. Medical Treatment

In the event of illness or injury, Planet MTB may arrange emergency medical treatment where reasonably necessary.

Participants remain responsible for all associated medical costs, evacuation costs and related expenses.


12. Photography and Media

Planet MTB regularly captures photos and video content during tours and events.

By participating, you grant Planet MTB a perpetual, royalty-free licence to use your image, likeness, voice and content for:

  • Marketing
  • Social media
  • Advertising
  • Website content
  • Promotional materials

If you do not wish to appear in media content, you must notify Planet MTB in writing before the tour commences.


13. Intellectual Property

All content on the Planet MTB website, including logos, graphics, photographs, videos, text and branding, remains the property of Planet MTB unless otherwise stated.

Content may not be copied, reproduced or distributed without prior written permission.


14. Privacy

Planet MTB handles personal information in accordance with our Privacy Policy.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.


15. Force Majeure

Planet MTB shall not be liable for failure to perform obligations where such failure results from circumstances beyond reasonable control, including:

  • Natural disasters
  • Extreme weather
  • Government restrictions
  • Pandemics
  • Travel disruptions
  • Industrial disputes
  • Acts of terrorism

16. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
